Facts: Annalee worked with two other housemaids in the Mañalac household. One day, she and another housemaid went on a drinking spree with Henry, a resident of the house. Annalee noticed a white substance on her glass and later felt dizzy. While she was in the bathroom, a power interruption occurred during which Henry appeared, pinned her to the door and then she lost consciousness. She woke up on Henry's bed and later discovered that she was abused. Annalee subsequently lost her sanity. The information averred force and intimidation but what was allegedly proved was that the unknown substance rendered Annalee unconscious. Henry pleads violation of due process, the right to be informed.
Issue: Whether the accused may be convicted under an information charging rape through force and intimidation.
Held: The prosecution was able to show that force was employed to consummate Henry's carnal design when the victim was pinned to the door during the power interruption. Irresistible force is not needed here to enable the rape to be committed with ease and facility, and where the complainant was already dizzy, it would not have required overwhelming force to render her unconscious. In fact, under this particular situation, the law does not even impose a burden on the rape victim to prove resistance. What needs to be established is the use of such force or intimidation by the accused that would be sufficient to consummate the deed.
